    Hello Rob,

    Thank you very much for contacting Prosthetic Records in regards to your recent incident on your youtube channel, Progressive Music Planet.

    After looking into the matter, I see that your video may have been flagged by mistake. The simple way to alleviate this situation would have been to contact me in regards to the incident and ask me to reinstate the video – which can be done by the click of a button.

    Prosthetic regularly has our staff go through user uploaded videos and take down anything that hosts a download link for our copyrighted material. As I mentioned, this is easily reversed and chances are your video was flagged by mistake. I am not accusing you of hosting links to illegal downloads. My signature is attached to every video claim, and I oversee them all as we do bulk takedown notices – I am only human, and sometimes mistakes happen. The fact of the matter is there are thousands of videos uploaded without permission and instances like this are bound to happen from time to time. When something like this does happen, if I’m contacted by the uploader and asked to reinstate, I do; assuming there are no links to download copyrighted material.

    Looking into the matter a little more, I see that your channel has been terminated due to “multiple third-party claims of copyright infringement regarding material the user posted.” – this is not the fault of Prosthetic Records, but the fault of your misconduct in regards to YouTube’s user agreement. In a nutshell, the termination of your channel, while caused by our flagging of your video, was not our fault entirely and was only a matter of time due to multiple third-party claims. To put it simply, it was bound to happen because you did not adhere to YouTubes user policy.

    In these special cases where channels are terminated because of a video we flag, if contacted by the user I can reach out to our representatives at Google and YouTube and explain the situation to them and ask that they retract our claim and reinstate the users channel. This does not mean that further third-party claims will not result in termination of the account.

    I’m sorry that you view our efforts in promoting Wayfarer as sub-par. We’ve spent thousands of dollars on advertisements in print publications the world over, in addition to procuring interviews and features in publications such as MetalSucks.net, Metal Hammer Magazine, New Noise Magazine, etc. and we work tirelessly to grow and build our bands careers.

    Moving on, I have noticed that you have taken this matter public via your website. While your views and opinions are entirely by right yours to have, the post made on your website naming myself and Prosthetic Records is not only dissembling, but also can and will be viewed as slander and defamation of character. I ask that you retract your web post immediately and handle any and all concerns you may have with myself or Prosthetic Records in a professional manor.

    I look forward to your response, as well as a chance to clean the slate between prosthetic and your brand.
